Generally:  These terms govern your use of and any services rendered until a Client Intake Form is signed. Your use of the website constitutes your acceptance of these terms. If you do not agree with these terms, do not use the website. We may modify or update these terms at any time by posting a new version on the website. Information on this website is provided in good faith, but “as-is” and “as available” without warranty of any kind. We have no responsibility over third party content that you may access through links on this website. This website is owned and operated by, and all services are provided by Hyp-Nova, LLC, a Virginia limited liability company.

Free Phone Consultations:  If you contact us for a Free Phone Consultation, you represent that you are local to the Northern Virginia Area (e.g., you live, work or travel to the area on a regular basis). The Free Phone Consultation is intended to gather more information to determine whether hypnotherapy may be beneficial to you and whether a doctor referral is needed prior to the first session. The Free Phone Consultation is provided for free, but is not intended to constitute the rendition of professional services or advice and will not be used for such purpose. Information contained in the Feedback Form or provided to us in the Free Phone Consultation will only be used to respond to your inquiry and discuss your situation. It will not be shared with any other person, except as may be required by law or legal process.

Hypnotherapy Sessions:  The Client Intake Form will describe the goals of the session, the applicable fees and will explain briefly the nature of hypnotherapy. If a Client Intake Form is not signed, then these Legal Terms will govern and you will be charged our standard reasonable rates.

Procrastination and No-Shows.  We realize some clients have issues with procrastination (like failing to show up for appointments). If you schedule an appointment, but fail to show up or cancel on less than 24 hours’ notice, we reserve the right to require pre-payment before scheduling another session. After the first cancellation, we charge 1/2 the session fee for cancellations with less than 24 hours’ notice. With the third cancellation, we charge the full rate. This compensates us for the opportunity cost of having blocked out time to see you, preparing for the session and possibly turning away other clients who sought to book the same time.

Pricing: The price for hypnotherapy sessions will be determined in advance during the Free Phone Consultation. We offer discounts for returning military combat troops, college students and certain other groups. If you are not in the discount group, remember that your payment of the regular fee helps subsidize those individuals to make hypnotherapy accessible to them. The first session is usually priced as a double-session (up to 120 minutes), since we need to explain hypnosis, the theory of mind and gather more background information during the face-to-face client interview.  Follow-on sessions are usually completed within 60 minutes.

Recording the Session: You are invited to record the session or bring a friend to observe, if you like. If you bring a friend, you consent to their presence. Any recording or transcript of the session will be for your own personal reference and will not be posted on the internet or distributed publicly by you without the written consent of Hyp-Nova, LLC. If you provide us a written testimonial, we may with your consent publish it on the website under the testimonials section.

Confidentiality:  Your session is generally treated as confidential. There are certain overriding situations in which information may be disclosed to others. For example: if you indicate a present intention to harm yourself or others, if there is child or elder abuse underway, then this could be disclosed to prevent harm that would outweigh the interests of confidentiality. If you have a friend or observer present then you consent to their observation.

Not for Medical or Emotional Disorders.  Hypnotherapy is strictly for vocational and avocational self-improvement and is not a treatment for medical or emotional disorders. If you are under a doctor’s care, you agree to obtain a doctor referral letter before hypnotherapy is obtained to ensure the doctor has determined that hypnotherapy is not contraindicated. You agree to obtain your doctor’s approval before changing or stopping any prescribed medication.

Disputes:  If we conclude that hypnotherapy is appropriate for you, we will use our good faith efforts to use hypnotherapy to help you achieve the mutually-agreed positive goals for the session. However, no hypnotherapist can guarantee the actual results, which will vary. All disputes will be initiated and maintained by you exclusively in Fairfax County General District Court located in Fairfax, Virginia. There is no liability beyond the juridictional limits of such court and any further claim is waived. Our liability is limited to a refund of the amount of fees actually paid by you for the allegedly defective service. In no event is Hyp-Nova, LLC, its owners or operators liable for any direct damages exceeding such fees actually paid, nor for any indirect, incidental or consequential damages, regardless of the legal theory or whether any limited remedy fails of its essential purpose. This relationship is governed by Virginia law, without regard to conflicts of law principles. Trial by jury is expressly waived. Claims may not be joined with any other claim(s). This document represents our entire and exclusive agreement on this subject and may only be modified by execution of the Client Intake Form or other writing executed manually by Hyp-Nova, LLC.
